MEMORANDUM FOR EXECUTIVE COUNCIL
PROPOSAL FOR THE CONTROL OF OBSCENE AND VIOLENT PUBLICATIONS
Introduction
This
memorandum makes a
recommendation on a refined proposal for the control of obscene and violent publications following further discussions with the Judiciary and consultation with Unofficial Members of the Legislative Council.
Background

On 26 November 1985, after considering memorandum XCC (85)156 (copy
(copy at Annex A), the Council advised and the Governor ordered :
(a)
that the Chief Justice's proposal described in paragraph 15 of the memorandum should be examined in greater depth in consultation with the Chief Justice;
(b) that soundings should thereafter be taken
among the legally qualified Members
Members of the Legislative Council and the ad hoc
group of Legislative Council Unofficials set up to. consider this problem to ascertain whether there would be adequate support in the Legislative Council for the refined proposal;
(c)
(d)
(e)
that a further submission
submission should thereafter be made to the Council with a recommendation on whether the refined proposal should be implemented;
that the matter should be accorded a high priority;
that the report of the working group should not be published but that the press should be told that the Council has examined proposals which require further discussions with the Judiciary and
with Legislative Council; and
the
consultation

that the Council's appreciation of achievements of the Working

identifying the issues should be recorded.
