(3) No person shall be convicted of an offence under

subsection (1) if it is proved that the article the subject

of a charge is, or was at the date he was alleged to have

committed that offence, classified as a Class I or a Class II

article.

(4) No person shall be convicted of an offence under

subsection (1)(b) or (c) if it is proved that the article the

subject of the charge was possessed or imported, as the case

may be -

(a) for the purpose of submission to the Registrar

(b)

under section 13; or

by a person licensed to broadcast under section 8

of the Television Ordinance for the purpose of

submission to the panel of censors under section

32 of that Ordinance.
