MEMORANDUM FOR EXECUTIVE COUNCIL
Public Health and Urban Services Ordinance
(Chapter 132)
PUBLIC HEALTH AND URBAN SERVICES (AMENDMENT) BILL 1986
INTRODUCTION
The purpose of this memorandum is to seek Members' advice on whether the Public Health and Urban Services (Amendment) Bill 1986 at the Annex should be introduced into the Legislative Council.
BACKGROUND

The Regional Council will come into being on 1 April 1986. Section 25 of the Regional Council Ordinance provides, inter alia, that the Council shall "exercise such powers and perform such duties as may, from time to time, be conferred or imposed on the Authority by the Public Health and Urban Services Ordinance". To enable the Council to discharge the functions envisaged for it under section 25 of the Regional Council Ordinance, it is necessary to amend the Public Health and Urban Services Ordinance ("the Ordinance") so as to make the Council the authority in respect of matters for which it is to be responsible. These include proposals to -
(a) transfer the Authority for the making of subsidiary legislation and the setting of fees, etc., under the Ordinance from the Governor in Council to the Regional Council;
(b)
(c)
transfer the Authority for performing executive functions under the Ordinance from the Director of Regional Services to the Regional Council;
re-delineate the geographical jurisdiction between the Urban Council and the Regional Council under the Ordinance;
(d) provide transitional arrangements to enable the Director of Regional Services to continue to perform the functions under the Ordinance after 1 April 1986 until such time as the Regional Council can assume such functions;
