(3) For the purpose of enabling due inquiry to be made as to whether a subordinate officer or member of other ranks should be required to pay any amount under subsection (2), affording him due opportunity to make representations and enabling any requirement under that subsection to be appealed against and reviewed, Part III shall apply mutatis mutandis to and in respect of such a requirement as it applies to and in respect of a finding of guilty of an offence against discipline in accordance with the provisions of the Third Schedule and an award of punishment.”.
4. The principal Ordinance is amended by adding after section 19 the following--
"Interpretation
of member" in
sections 18
and 19.

19A. In sections 18 and 19, "member" includes any person employed in the Fire Services Department.".
The Third Schedule to the principal Ordinance is amended-
(a) in Part I, by deleting paragraph (1)(b); and
(b) in Part II---
(i) in paragraph (a)(vii), by deleting the semicolon and substituting a full stop; and
(ii) by deleting paragraph (b).
6. Paragraph 1 of the Fourth Schedule to the principal Ordinance is amended-
(a) in sub-paragraph (b), by deleting the full stop and substituting a semicolon;
and
(b) by inserting after sub-paragraph (b) the following-

"(c) any order or requirement for payment in respect of loss or damage
made by the Governor or Director under section 14C.".
The Seventh Schedule to the principal Ordinance is deleted and replaced by the following
(b) subject to a right of appeal, to provide, in the case of loss or damage to Government resulting from the neglect or fault of a subordinate officer or member of other ranks, for payment for such loss or damage to Government, by such subordinate officer or member of other ranks (clauses 3, 5 and 6).
2. The Bill will not affect the general revenue or Public Service staffing requirements.

Explanatory Memorandum
The objects of this Bill are-
(a) to extend the application of the Fire Services Department Welfare Fund established under section 18 of the principal Ordinance to all members of the staff of the department (clauses 2, 4 and 7);
