THE DRUG ADDICTION TREATMENT CENTRES (AMENDMENT) ORDINANCE 1986

This Ordinance amends the Drug Addiction
Treatment Centres Ordinance.
2. Section 2 amends section 4 of the principal Ordinance to reduce the minimum period of detention in a Drug Addiction Treatment Centre ("DATC") from 4 months. to 2 months.
3. Section 3 amends section 6 of the principal Ordinance so that a person released from a DATC under a supervision order and who is later recalled to the DATC shall, on his release from that period of recall, continue to have the benefit of any unexpired portion of that supervision order.

Under section 6A of the principal Ordinance if a person the subject of a detention order, supervision order or recall order is sentenced to imprisonment for more than 2 years that order lapses. Section 4 amends this section to reduce the period of 2 years to 9 months.
5. To avoid multiple supervision by the Commissioner of Correctional Services and other persons (e.g. Director of Social Welfare) section 5 adds new section 6B to provide. that an existing supervision order shall lapse if the supervised person is put under the supervision of a person other than the Commissioner.
6. Section 6 amends section 109AA (2) of the Criminal Procedure Ordinance consequent upon the amendment in section 4.
7. The Ordinance does not affect supervision orders made before its commencement.
8. Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do sp.
