5. Subject to section 4(2) of the principal Ordinance, amendments made by this Ordinance shall apply in the case of the death of a person suffering from pneumo- coniosis who died from a cause other than pneumoconiosis before the commencement of this Ordinance as they apply in the case of such a death which occurs after such
commencement.
Explanatory Memorandum
The amendments in this Bill provide greater flexibility for the payment of compensation under the Pneumoconiosis (Compensation) Ordinance to the depend- ants of a pneumoconiotic who dies from a cause other than pneumoconiosis.
2. The amendments in clause 2(a) require the dependants of a person who suffers any incapacity resulting from pneumoconiosis but dies from a cause other than pneumoconiosis to notify the Commissioner for Labour of the death if they wish to claim compensation. The Commissioner may then, as provided in clause 2(b), inquire into the dependancy relationship. Clause 2(c) extends the power of the Commissioner under section 14(3) so as to enable him to request the Pneumoconiosis Medical Board to determine whether any permanent incapacity had resulted from pneumoconiosis prior to the death.

The amendments in clause 3 give effect to what is stated in paragraph 1 above, where the pneumoconiotic dies before compensation is paid to him, by enabling the dependants to claim compensation whether the Penumoconiosis Medical Board has issued its certificate (determining the date, and assessing the degree, of the incapacity of the pneumoconiotic) before or after the death.
4. The amendments in clause 4 are consequential and relate to the certificate of incapacity. The new subsection (1A) in clause 4(a) provides that the determination and assessment is to be made from the records of the medical treatment given to the deceased person.
5. Clause 5 provides that the amendments in this Bill will also apply where an incapacitated person died from a cause other than pneumoconiosis before this Bill comes into operation. However, by virtue of section 4(2) of the Pneumo- coniosis (Compensation) Ordinance, such death must have occurred on or after 1 January 1981.
6. The Bill will not result in any additional Public Service staffing requirements or additional public expenditure.

草案第四條所作出的因應修訂是與喪失工作能力證明書有關。草案 第四條(a)款加列新條款,即第(1A)款;該款規定委員會得依據死者生前醫 療紀錄而作出判定和評估。
五、 草案第五條規定:因患該病以致喪失工作能力並在本條例草案生效 前逝世者,即使死因並非該病,本條例草案所作修訂亦予適用;但根據肺塵埃 沉着病(賠償)條例第四條第(2)款的規定,有關死亡日期必須為一九八一年一 月一日或在該天以後。
六、
本條例草案將不會導致政府人手及開支方面有任何額外增加。
