THE PNEUMOCONIOSIS (COMPENSATION) (AMENDMENT)
ORDINANCE 1986
(No. 15 of 1986)
The purpose of this Ordinance is to amend the Pneumoconiosis (Compensation) Ordinance to provide greater flexibility for the payment of compensation to the dependants of a pneumoconiosis victim who dies from a cause other than pneumoconiosis.
2. Section 2 amends section 14 of the principal Ordinance to provide a procedure to deal with compensation claims in such cases. Section 3 amends section 17 of the principal Ordinance to enable compensation to be claimed whether the Pneumoconiosis Medical Board issues its certificate of incapacity before or after the death of the pneumoconiotic. Hitherto it was necessary for a certificate to be issued before death.
3. Section 5 provides that the amendments in this Ordinance will apply also in the case of deaths that have occurred on or after 1 January 1981, the commencement date of the principal Ordinance.
4. Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
