LOCALISATION OF CIVIL AVIATION LEGISLATION
1.
Peter Heady, ESB, Hong Kong and Peter Lok, CAD, Hong Kong are keen to mak
progress on the localisation of Civil Aviation Legislation. I attended a meeting in the DTP yesterday with Heady and Lok chaired by Gavin Lord.
Unfortunately, Chris Whomersley was not present.

Heady presented copies of the attached papers. (Para 4 of the note on discussions outlines broadly the areas of concern.) The list of Acts and Orders in Council which currently apply to Hong Kong is useful and the first such document I have seen.
3. Heady and Lok would welcome guidance on how best to proceed with localisation. I said that, for the momen t at least, a general statement of intended legislation in Hong Kong rather than a specific draft of each case would be more useful. As far as the question of what form an order in Council here should take I said
thought it would probably have to be quite specific rather than general but that the timing and drafting of the order would have to be the subject of close liaison between HKG, FCO and DTp.

Hong Kong would like to enact a Civil Aviation ordinance by the end of 1986, but the deadline is one they have imposed on themselves simply to get things moving as far as Ι could ascertain. I also said that I thought their general statement should outline the powers that they would like to have.
(We may have reservations on some of them.)
5. They would also like to meet Paul Fifoot (in the absence of Chris Whomersley) before they return to Hong Kong to discuss the way ahead. Should I encourage this or do you think it is better
for us in
in the department to give more thought to the timetable for localisation of legislation before we encourage Hong Kong to get too involved in drafting.

I have also discovered that we still owe Hong Kong a reply to their telno 2307 of 28/10/86 about localisation. I am copying the telegram to Legal Advisers for comments.
I attach a draft letter from Mr Galsworthy to Hong Kong about the subject of localisation.
