I have seen copies of Hong Kong tel Nos 630-632 and we have spoken on the telephone.

The matters raised by Hong Kong are, I believe, primarily for your Legal Advisers to pursue although we would be grateful to be kept generally in touch on how you propose to respond to Hong Kong, particularly as regards 1,2,6,8 and 18 (3) of tel No 631.

At this stage, I would only mention that we might need to retain reserve powers (until June 1997) on 1 and 2 of tel No 631 - given our ultimate responsibility for Hong Kong's external affairs and, I assume, the errors or omissions in their legislation in this respect. On 8, we will need to ensure that until such time as Hong Kong has its own ASAs with bilateral partners, the exercise of their powers remains subject to the provisions of bilateral ASAS, and any arrangements made under the ASAS, negotiated by the UK on behalf of Hong Kong. In other words, full automony in giving effect to the powers sought at 8 will be a gradual affair depending on the speed with which we are able to secure the establishment of separate Hong Kong ASAS.
