HONG KONG AIRCRAFT REGISTER AND LOCALISATION OF CIVIL AVIATION LEGISLATION
Thank you for your letter of 7 November 1986 and the attached paper out- lining Hong Kong's plans for localisation of their civil aviation legis- lation.
The programme outlined appears to be very sensible as far as it go es, particularly with regard to the register. The timescale is perhaps optimistic given the size and complexity of the task. The Department of Transport would need to be satisfied that the new legislation meets their responsi- bilities with regard to compliance with the Chicago Convention, and would sensibly expect to be consulted, and probably in turn wish to consult the CAA Legal Adviser and ourselves.
As the new Hong Kong legislationis introduced I presume that references to Hong Kong in the related UK legislation would need to be deleted. Would not UK Ministers concerned lose their existing control of aviation related matters in the Territory, and therefore find it difficult to ensure compliance withICAO requirements if the need should ever arise? If such were to be the case, could the Department of Transport sensibly continue to accept responsibility for such compliance? As advisers to the Department on ICAO compliance, we would be interested to hear their views.
