EASTERN HARBOUR CROSSING

Following Members' consideration XCS (85)7 on 3 December 1985, the Governor alia:

that a letter of acceptance of the stand alone offer of the New Hong Kong Tunnel Consortium should be issued;

that the letter should be in

be in the terms set out in Annex E to the memorandum with an addition to make it clear that the acceptance is on the basis of acceptance of joint and several liability by the companies participating in the consortium and addressed to each of the four participating companies in the consortium;

that each of the addressees of the letter should be asked to confirm his understanding and agreement with the letter by signing and returning a duplicate of the letter and that if any addressee was not prepared so to sign the matter should be referred back to the Council.

The Attorney General's Chambers prepared four letters of acceptance in accordance with these instructions which were duly signed by each member of

member of the consortium. See copies attached at Annex A to D.

There now exists a contract between Government and the Consortium which is jointly and severally binding on the individual members of the consortium, subject only to the coming into force of the Eastern Harbour Crossing Ordinance.
