attached at Annex E. It is accepted that the impact of the approach road system is significant and requires a major re-consideration of land use in the area. In revising the Quarry Bay Outline Zoning Plan considerable emphasis is being placed on the provision of District Open Space with extensive landscaping aimed at creating a parkland effect. Environmentally therefore it is considered that the revised land use will result in an improvement over the original planning which called for substantial urban developments in front of the parts of Taikoo Shing estate affected by the tunnel project.

Courses of action available

Under section 11 of the Ordinance, the Governor in Council may -
(a)
(b)
decline to authorise the works and the use;
or
the use, with or subject to such amelioration or of effects of the works, as
authorise the works and without modification and conditions, as to the avoidance of the effects thought fit; or
(c) under subsection
(3), refer the plan,
the
scheme and the objections to the Town Planning Board for report and advice.
Consequence of authorising the works and use

As a consequence of a decision to authorise the works and use under section 11(2) of the Ordinance, the powers of the Governor under section 13 of the Ordinance, relating to the resumption of land described in paragraph 10 may be exercised, as may the powers of the Secretary for Lands and Works under sections 17, 18, 19 and 20, described in paragraphs 12, 13 and 14.
Implications of not rejecting the objections

After an intensive assessment period and extensive negotiations to obtain favourable terms in respect of design, operation and finance, agreement was reached between Government and the New Hong Kong Tunnel Consortium subject only to the enactment of the
Harbour Crossing Ordinance.
