MEMORANDUM FOR EXECUTIVE COUNCIL

Dangerous Goods Ordinance (Chapter 295)

DANGEROUS GOODS (SHIPPING) (AMENDMENT) REGULATIONS 1985

Annexed for Members' consideration are the Dangerous Goods (Shipping) (Amendment) Regulations 1985. The purpose of this memorandum is to seek Members' advice as to whether these Regulations should be made.

Part I of the First Schedule to the Dangerous Goods (Shipping) Regulations lists approved petroleum wharves for the berthing of Type II and Type III vesselsl. Part II of the First Schedule lists wharves for the berthing of Type III vessels only.

Proposal

The Hong Kong Electric Company has requested that its jetty at Po Lo Tsui on Lamma Island and its wharf at Ap Lei Chau be deleted from Parts I and II respectively of the First Schedule.

"Type II vessel" means any vessel trading to or from Hong Kong and conveying dangerous goods in category 5 in bulk. These are substances that give off inflammable vapour.

"Type III vessel" means any vessel trading exclusively within the waters of Hong Kong and required to be registered or licensed pursuant to the provisions of the Merchant Shipping Ordinance (Cap 281). Before they can carry dangerous goods such vessels must be specifically licensed to do so by the Director of Marine.
