(ii) take all reasonable precautions in dealing with
all information documents and papers submitted to it by the H.K. Government and with the originals and copies of any reports documents papers or information or draft reports documents and papers submitted or provided by the Inspectorate to the H.K. Government so as to prevent any unauthorised person from having access to such information documents reports or papers.
The H.K. Government shall be entitled to vary or amend the said duties of the Inspectorate at any time subject to agreement with the U.K. Government.

The U.K. Government and the Inspectorate shall take instructions and directions and where appropriate receive the views and decisions of the H.K. Government and submit all reports only through the H.K. Government's Mass Transit Adviser (hereinafter called "the Adviser") and subject to any limitations imposed by the Adviser in any letter of authority granted by him such other person or persons to whom the Adviser may delegate his powers (hereinafter called the "Adviser's Representative").

The U.K. Government undertakes that the Inspectorate will exercise all necessary skill care and diligence in the discharge of the said duties.

The H.K. Government shall pay to the U.K. Government in respect of all work carried out by the Inspectorate in pursuance of its said duties the appropriate sum or sums specified in accordance with the Second Schedule hereto or otherwise as may be agreed such payments to be made within 28 days of the day following receipt by the H.K. Government of the U.K. Government's certified invoice.

The H.K. Government hereby agrees to indemnify the U.K. Government and the Secretary of State for Transport in that Government against all claims, demands or liability which may be made against, or incurred by, the U.K. Government the Secretary of State for Transport or any servant of the Crown in that Government, as a result of anything done or omitted by any member of the staff of the Railway Inspectorat in the U.K. Department of Transport in the course of the performance by that member, with respect to railways or proposed railways in Hong Kong, of any of the functions which in accordance with the arrangement now being concluded between the two Governments, are to be performed by members of that staff.
