Implication of not authorising the scheme

Should the scheme not proceed as planned, the segregation of vehicular and pedestrian traffic would be delayed and thus relief to the junction of Hennessy Road and Percival Street could not be accomplished.

Financial implications

The estimated cost of the works for this scheme is $3.5 million. Funds are reserved in the Capital Works Reserve Fund under Head 705 - Engineering. No resumption and clearance cost will be incurred. It is unlikely that the objector can substantiate any claims

claims for compensation under the provisions of the Roads (Works, Use and Compensation) Ordinance.

Public reaction

In view of the long term benefits of the scheme, it should be well received by the general public although it is possible that there may be continued opposition from the person who lodged the objection.

Publicity

If the scheme is authorised to proceed, a press release will be issued to announce Members' decision. It will emphasize the benefits of the project to the public at large.

(a)

Members are asked to advise whether :

under section 11(3) of the Roads (Works, Use and Compensation) Ordinance (Chapter 370)

the Governor in Council should exercise his discretion to refer the plan, scheme and objections to the Town Planning Board for a report and advice; or

to

(b) under section 11(2)(a) of the Ordinance the

Governor in Council should authorise the works and the use;

decline or
