The demolition of the part of the canopy will cause damage to the structure and overall appearance of the building, and constitutes an infringement of private property rights, which in this present case should be safeguarded particularly in the absence of any compelling reasons pointing to the absolute necessity of such demolition;

As mentioned before, the northeastern corner of the building from the ground floor to the fifth floor are all occupied by various banks. Security is of particular importance, but the footbridge creates a hazard. It is unlikely that the installation of security fencing would dispel all threats or apprehension of such hazard, and would therefore not only lower the rental value of the premises, but would interfere with the enjoyment of those premises by the present banks who have been very long term occupants.

The footbridge would be a blockage and would cause substantial loss of light and view affecting the lower floors.

It seems obvious to our clients that the planners of the roadworks had been oblivious to the private rights of ownership of our clients' property. Notwithstanding that there will foreseeably be some compensation for the loss of value of the building because of the footbridge, the grounds of objection set out herein and in the copy letter hereto annexed do indicate that some of the effects of the footbridge would be such loss of use and enjoyment of the building or such parts thereof which can in no way be compensated in monetary terms or otherwise. The construction of such footbridge arbitrarily imposes a price on the owners of the building. And this is manifestly unjust and unequitable.
