which shall be paid to such persons, at such places, and in manner as the company may, by notice annexed to the list of fares exhibited under subsection (3). appoint.

(2) Where the company issues a monthly ticket for the use of the tramway, the charge for the monthly ticket-

(a) shall not be less than--

(i) $100 for an adult; or

(ii) $50 for a student under the age of 16 years who holds a valid student travel card issued by the Commissioner for Transport:

(b) subject to paragraph (1), shall not exceed 25 times the

lowest fare for a full distance single journey.

(3) A list, printed in the English and Chinese languages, of all the fares to be charged and the monthly ticket charge shall be exhibited in a conspicuous place at the offices of the company and inside each carriage used upon the tramway.".

Amendment of section 28.

Section 28 of the principal Ordinance is amended-

(a) by deleting “seize” and substituting the following

“arrest without a warrant"; and

(b) by deleting "conveniently taken to a police station for safe custody and detained until he is discharged by due course of law" and substituting the following-

(Cap. 232.)

Amendment of section 33.

"handed over to a police officer and such police officer may take such person into custody without a warrant and the provisions of sections 51 and 52 of the Police Force Ordinance shall apply accordingly”.

10. Section 33 of the principal Ordinance is amended by deleting “toll” and substituting the following-

"fare".

11. Section 35 of the principal Ordinance is repealed.

Repeal of section 35.

Deletion of Schedule.

12. The Schedule to the principal Ordinance is deleted.

5. The Bill has a public finance implication in that the company will pay to the

Government a premium of $2,600,000 for the right to run and operate the tramway.

The premium will be dealt with in accordance with Annex III of the Joint Declara- tion. There are no Public Service staffing implications.

一九八五年山頂纜車(修訂)條例草案

草案第八條內載新訂第二十二條規定:山頂纜車有限公司可釐訂其 各項單程車費和月票收費額。月票收費額不得超逾單程全程最低車費的二十五 倍,並須符合下述準則:成人月票費不得少於100 元,而年齡未滿十六歲的學 生月票費不得少於50元。草案第十二條條文(關於刪除現行山頂纜車收費表)是 一項因應作出的修訂條款。

五、 本條例草案對政府開支方面的影響如下:山頂纜車有限公司須向香 港政府補付地價260萬元,以獲取山頂纜車的管理及經營權。上述補付地價措 施將按照《中英聯合聲明》附件三的規定處理。本條例草案對政府人手需求方 面,則並沒有影響。

Explanatory Memorandum

The main purpose of this Bill is to alter the arrangements giving the Peak Tramways Company Limited the right to run and operate the Peak tramway over the land on which the tramway is constructed (clause 2), and to enable the company to charge such fares as it thinks fit for the use of the tramway (clause 8).

2. The new section 2A in clause 2 gives the company the right to run and operate the tramway for 20 years with effect from I January 1984 subject to the payment of a premium of $2,600,000. The repeal of sections 21 and 21A (which provide for the payment of a permit fee) by clause 7 is consequential.

3. The amendments in clauses 3. 4. 5. 6,9,10 and 11 bring up to date the provisions of the principal Ordinance. The amendments do not make substantial changes.

4. The new section 22 in clause 8 enables the company to fix the fares for single journeys and the charge for monthly tickets. The charge for a monthly ticket is not to exceed 25 times the lowest fare for a full distance single journey, provided that the minimum charge is $100 for an adult and $50 for a student under the age of 16 years. The amendment in clause 12 (to delete the existing table of fares) is consequential.
