THE ROAD TRAFFIC (AMENDMENT)(NO. 2) ORDINANCE 1986
(No. 43 of 1986)
The amendments in this Ordinance relate to disqualification of a person from holding or obtaining a driving licence.
2. The amendment in section 2 abolishes obligatory disqualification for a third or subsequent speeding conviction within 3 years. The Road Traffic (Driving- offence Points) Ordinance (Chapter 375) will continue to apply to speeding offences.
3. The effect of the amendments in section 3 is that the courts will have a discretionary power of disqualification on convicting a person for any speeding offence, and for certain specified offences will be required to disqualify the offender from holding or obtaining any type of driving licence.
4. By section 4 the power to order a person to take a driving test is made discretionary in all cases.
5. Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
