11. MR. ANDREN WONG, LIKE MR. MARTIN LEE, ALSO PICKED UP THE CONSTITUTIONAL PROBLEMS HIGHLIGHTED BY THE DAYA BAY ISSUE. HE
STRESSED THAT IT WAS ONLY THROUGH THE CRITICAL PROBING ON THE PART
OF THE COUNCIL AND THE PROVISION OF INFORMATION AND EXPLANATION ON
THE PART OF THE GOVERNMENT THAT A GENUINE SEPARATION OF POWERS
BETWEEN THE EXECUTIVE AND THE LEGISLATURE COULD BE ACHIEVED. HE
ALSO POINTED OUT THAT THE CONTROVEROY OVER DAYA BAY THREW LIGHT ON THREE POINTS OF MAJOR CONSTITUTIONAL SIGNIFICANCE. THESE THREE POINTS HAD TO DO WITH THE POWERS AND PRIVILEDGES OF LEGCO, THE GOVERNOR'S DUAL ROLE AS CHIEF EXECUTIVE AND AS PRESIDENT OF THE LEGISLATURE: AND THE QUESTION OF THE DUAL EXECUTIVE-LEGISLATIVE ROLE. MR. WONG PROPOSED THAT ALL STANDING AND SELECT COMMITTEES WHICH WERE SUPERVISORY AND SCRUTINEERING IN NATURE SHOULD COMPRISE NON-EXECUTIVE MEMBERS ONLY.
12. MR. SZETO WAH, ONE OF THE HARDCORE ANTI-DAYA BAY MEMBERS, SAID THAT THE PUBLIC CONCERN OVER THE DAYA BAY PROJECT HAD NOT DISAPPEARED AFTER THE SIGNING OF CONTRACTS. THE PLANT WOULD BECOME A REALITY IN THE YEARS TO COME AND THIS WOULD LEAD TO MORE WORRIES AND FEARS. THERE WAS STILL A POSSIBILITY OF HALTING THE NUCLEAR PROJECT BECAUSE CHINA HAD PROMISED THAT THE PROJECT WOULD NOT BE LICENSED IF SAFETY MEARUES DID NOT MEET THE INTERNATIONAL STANDARDS. THE STRUGGLE FOR THE SHELVING OF THE PLANT AND ITS CONTINUCUS MONITORING WAS, THEREFORE, INTERRELATED. MR. SZETO CRITICISED THE GOVERNMENT FOR USING **COMMERCIAL CONFIDENTIALITY AS AN EXCUSE FOR NOT RELEASING INFORMATION.
13. MR. HUI YIN-FAT, LIKE SOME OF HIS ANTI-DAYA BAY COLLEAGUES, REGRETTED THAT THE GOVERNMENT HAD NOT PAID DUE REGARD TO THE ANTI- DAYA BAY PETITION LODGED BY MORE THAN ONE MILLION PEOPLE. HE CALLED FOR RELEASE OF THE LAZARD BROTHERS REPORTS AND HARWELL REPORTS AND STRESSED THAT PUBLIC INTEREST SHOULD HAVE PRIORITY OVER COMMERCIAL INTEREST.

14. MR. LEE YU-TAI WAS ANOTHER ELECTED MEMBER WHO INDICATED THAT THE LEGISLATIVE COUNCIL (POWERS AND PRIVILEGES) ORDINANCE SHOULD BE USED TO SEEK THE RELEVANT INFORMATION ON DAYA BAY. HE MAINTAINED THAT THE MONOPOLY ENJOYED BY CLP LIFTED THE NEED FOR COMMERCIAL CONFIDENTIALITY OVER THE DAYA BAY PROJECT. HE ALSO PRESSED FOR GUARANTEES THAT THE NUCLEAR OPTION WOULD RESULT IN CHEAPER ELECTRICITY FOR HONG KONG CONSUMERS.
15. MRS. SELINA CHOW AS ONE OF THE MANY MEMBERS WHO WAS INTERESTED IN CHEAP ELECTRICITY FROM DAYA BAY. IN HER VIEW, IT WAS NOT GOOD ENOUGH THAT HONG KONG HAD BEEN ASSURED NUCLEAR POWER WOULD NOT COST MORE THAN COAL-FIRED ELECTRICITY. MRS. CHOW STRESSED THAT THE ELECTRICITY FROM DAYA BAY SHOULD BE CHEAPER AS THE COMMUNITY SHOULD BENEFIT ECONOMICALLY FOR HAVING SOMEWHAT SACRIFICED OUR PEACE OF MIND. SHE NEVERTHELESS RECALLED THAT THE
