The proposal outlined in paragraph 3 was contained in Bill annexed to XCC(85)157. However, on further consideration, it is concluded that there are adequate powers in the Legislative Council (Electoral Provisions) Ordinance 1985 (No. 13 of 1985) to proceed by way of regulations. regulations at Annex A seek to modify the Legislative Council (Electoral Provisions) (Registration of Electors and Appointment of Authorized Representatives) Regulations 1985 (LN 89/85) ("the principal regulations"), to provide for the registration of the Regional Council members as electors in the existing final register. The principal regulations are amended by adding a new Part IX which modifies Parts IV and V of the principal regulations in the
in the same way as intended by the Bill. The new Part IX will become spent on publication of the normal final register in August 1986.

The timetable of events as indicated in paragraph 7 of memorandum XCC (85)157 has been agreed with the Provisional Regional Council: it concludes with the date of the election on 5 June 1986. It is therefore proposed that the timetable should be maintained in the regulations.

It is considered that the more informed will see the amending regulations for what they are; a measure simply to enable the Regional Council, following its inauguration, to return a member of its own choosing to the Legislative Council. However, against the background of the registration exercises which have taken place in 1985, it is possible that some in the community may be a little confused by this further exercise to register specifically the members of the Regional Council.

A press release will be issued when the regulations are gazetted. It will explain the purpose of the amending regulations and emphasise that this is a one-off exercise to meet the one-off situation arising from the establishment of the Regional Council on 1 April 1986.
