Wong's behaviour, that it was necessary to enter the flat

forcibly in order to ensure the safety of the child. The

power to use force to enter premises in such circumstances is

contained in section 44(1) of the Ordinance.

The Director of Social Welfare has concluded in her

report that the use of force to enter premises must be

regarded as a last resort, but that it was justified in the

circumstances at the time. The UMELCO Panel have also

considered that the break-in might be necessary in these

circumstances. The Attorney General's Chambers have advised

that the steps taken by the Director of Social Welfare and her

staff were taken lawfully in accordance with the provisions of

the Protection of Women and Juveniles Ordinance.

Panel

As for the effect which the break-in had, the Panel

believe that it was not a factor contributing to Madam Wong's

illness. This point has been confirmed by the psychiatrists

who have examined her and found that she had been ill for some

time. Nonetheless the Panel have observed that the forcible

entry had contributed to the stress on Madam Wong. I accept

this observation as fair, but would simply add that the
