Introduction

On 19 November 1985, Members noted the contents memorandum XCRI(85)26 (copy at Annex A) which explained the scope, implications and timing of an ongoing review of airport height restrictions being conducted by the Director of Civil Aviation. Phase 1 of the review is now complete and the purpose of this memorandum is to seek Members' advice on proposed amendments to the Hong Kong Airport (Control of Obstructions) (Consolidation) Order to implement the revised height limits recommended.

Background

The Hong Kong Airport (Control of Obstructions) Ordinance, Chapter 301, (The Ordinance) was enacted in 1957 to provide for the restriction of building heights required for the safety of aircraft using Hong Kong Airport. The height limits and the areas to which they apply were designated by orders made under section 3 of the Ordinance. In 1982 these were consolidated into the Hong Kong Airport (Control of Obstructions) (Consolidation) Order with exemptions listed in the schedules thereto. The height limits prescribed have been broadly based on International Civil Aviation Organisation

(ICAO) standards and guidelines but

but also took into account local topography and existing buildings. Revisions have been made from time to time as necessary to meet changing safety requirements.

As explained in Annex A, in 1982 the ICAO guidance material on the construction of flight procedures was extensively revised. This, coupled with a number of other factors such as the need

the need to determine height limits for newly reclaimed land and the need to bring into effect restrictions for the protection of new radio-navigational aids, initiated an overall review of airport height restrictions in 1982. Because of its complexity, the review has had to be conducted on phased basis and first priority has been given to an area to the southeast of the airport. (Phase 1). The review of height limits in this area has recently been completed.
