Cancellation of Fixed Ptich Licence - Application for Review of Decision by Mr. CHENG Leung-ngan (paper HST (ST)/37/86 )

(Mr. Cheng was invited into the meeting at 12.25 p.m.)

NOTED:

(1) Mr. Cheng's explanation that his fixed pitch was not viable and he had to hawk illegally in order to support his family;

(2) Mr. Cheng's reply to the Chairman's question

that he want to retain his licence so that he could get a pitch in the Shui Wo Street UC, Complex in future;

(3) Mr. Tong's point that holder of a Fixed Pitch

Hawker Licence was required to operate his/her pitch personally; that if Mr. Cheng failed to fulfill this requirement, his licence would be ⚫cancelled;

(4) Mr. Cheng's reiteration that his pitch was not

viable and he could not earn a living by trading at the fixed pitch; that, however, he wanted to retain his licence;

(5) SS(KE)'s point that there was no plan to resite

hawkers now trading in Mut Wah Street to the Shui Wo Street Market Complex; his further point that the Department had found that Mr. Cheng's pitch was now occupied by a Madam CHAN King; his understanding that Madam Chan was a relative of Mr. Cheng;

(6) Mr. Cheng's response that he did not know Madam
