to make subsidiary legislation under various Ordinances subject to the concurrence of the Governor;
to make recommendations on pardons to the Governor.
1995
The post of Deputy Governor is filled by the person who is to be the Chief Executive (designate), with the appropriate change in title during that year.
He continues to carry out the functions already allocated and delegated to the Deputy Governor.
The Chief Executive (designate) assumes the presidency of Executive Council in regard to major policy matters. Foreign affairs and defence are retained by the Governor.
The Governor delegates the power to grant pardons and remissions to the Chief Executive (designate).
If the Public Services Commission remains advisory, the Chief Executive (designate) assumes from the Governor delegated powers relating to public service appointments, referring to the Secretary of State in regard to specified senior officers.
The Chief Executive (designate) assumes responsibilities in regard to security forces other than the garrison.
1997
The Chief Executive (designate) has by now for some two years been exercising the powers which he will exercise on 1 July 1997 as Chief Executive.
On 1 July the Governor's powers and HMG's powers in regard to foreign affairs and defence pass to Peking.
Arrangements will have been made for members of the public service and judiciary to become servants of the Special Administrative Region Government in place of the Hong Kong Government. The principal judges and principal officials should have been confirmed in office by the PRC in advance of that date.
