Issus of a Fixed Pitch (All Classes) Hawker Licence Application for Review of Decision by Mr NGAN Chiu-yə

PURPOSE

To consider an application by Mr NGAN Chiu-yum for a review of the Department's decision to refuse his application for the issue of a Fixed Pitch (All Classes) Hawker Licence in respect of Fixed Pitch No. 49 in Jardine's Crescent, Wan Chai, Hong Kong.

BACKGROUND

NGAN Chiu-yum, applied on 19 April 1985 (Appendix I) for the isane of à Fixed Pitch (All Classes) Hawker Licence in respect of the vacant pitch at Fixed Pitch No.49 in Jardine's Crescent, Wan Chai, Hong Kong.

On his application, Hr NGAN was interviewed by staff of the department on 29 April 1985 (Appendix II).

Acting in accordance with the prevailing Council's policy of not issuing new Hawker Licences, Mr NGAN's application was refused and informed in writing on 12 July 1985 (Appendix III).

On 16 July 1985, Mr NGAN appealed against the decision of the department (Appendix IV) on the following grounds:-

1)

that he has been a hawker engaged in the selling of eggs since the 1950s;

that he has no other means of earning a living for his family except hawking; and

6.

iii) that he has been assisting the licensee of Fixed

Pitch No. 48 Jardine's Crescent for over ten years. Moreover, he has also assisted the late licensee of Fixed Pitch No. 49 Jardine's Crescent before his death.

At an interview by district staff on 3 August 1985, Mr NOAN has nothing to add to what have already been stated in his letter of appeal.

DEPARTMENTAL VIEWS

The department recommends that the appeal by Kr NGAN be refused on the following grounds:-

1) Mr NGAN is not without a job as he is assisting the licenses

of Fixed Pitch No. 48 in Jardine's Crescent, Wan Chai, Hong Kong;

ii)

it is the current policy of the Council not to issue nev hawker licence; and

iii) it is the basic policy of the Council to dissociate street'

trading from social welfare.
