Chapter VI - Provisional closure order scheme to suppress nuisance caused by

vice-associated establishments

INTRODUCTION

In June 1984 the Committee endorsed proposals by the Working Group on Vice-associated Establishments and Environmental Nuisance to ease the problem of nuisance caused by vice-establishments in residential buildings with a scheme involving the use of closure orders. Under this scheme the courts would be asked to make provisional closure orders in cases where nuisance was proved by a number of residents, and by such organisations as Mutual Aid Committees or Residents' Associations. It was reported in Chapter VI of FCC Report No. 4, that the City and New Territories Administration (CNTA) had consulted the District Boards (DBS) and District Fight Crime Committees (DFCCs) on the proposals. a result of points made by the DBs and DFCCs, the CNTA is revising the Bill.

PRESENT POSITION

6.3

The DBS and DFCCS supported in principle the proposed scheme. The CNTA circulated, in early July, preliminary drafting instructions to modify the draft Bill prepared by the Working Group. At the same time, an outline of the administrative procedures and the outcome of consultation with the departments concerned were circulated to the District Offices with a view to assessing the popularity and practicability of the proposed scheme.

ADMINISTRATIVE PROCEDURES FOR THE PROVISIONAL CLOSURE ORDER SCHEME

6.4

The proposed administrative procedures for the scheme, which have been drawn up by the CNTA in consultation with the Registrar, Supreme Court, the Law Draftsman and the Commissioner of Police, are as follows

the complainants would approach the relevant District Office to record their complaints in a prescribed form;
