HONG KONG: NEW FORM OF GOVERNMENT LEASE
Problem
1.
To issue an instruction to permit land to be granted in the name of the Government of Hong Kong, consequent upon the amendment recently made to the Letters Patent providing that land grants should no longer be made in the name of
The Queen.
Recommendation
2.
I recommend that pursuant to Article XIII(4) of the
Letters patent the Secretary of State issue an instruction
to the Governor of Hong Kong along the lines of the
attached draft.
This instruction would not be for
publication but could be produced in legal proceedings if anyone challenged the new form. Legal Advisers concur.
Background
3.
An amendment to the Letters patent was made in July 1986 which had the effect of removing the requirement that grants of
of land in Hong Kong be made in the name of the
Crown. This amendment was a consequence of the agreement
reached in the Sino-British Land Commission to remove
