Amendments of specific parts of legislation e.g. schedules, rates,
taxes, fines, fees etc. should, if the reasons set out in paragraph 5 apply, be made
by the Legislative Council by resolution unless it is considered that the matter is too minor to concern it (e.g. amendments to the rates of interest to be paid on Tax Reserve Certificates) greater speed or flexibility is needed in which case the power should be delegated to the Governor or the Chief Secretary.

All subsidiary legislation should continue to be laid on the table of the Legislative Council and be the subject of either a positive (section 35) or negative resolution (section 34). A positive resolution should be required in the following cases:
(a) by-laws made
made by
by non-representative bodies i.e. other
other than by the Urban and Regional Councils;

(b) if, for special reasons (e.g. a need for the
Kowloon-Canton Railway to - make regulations and by-laws), it is considered desirable to delegate the power to make regulations to other persons or bodies.

No publicity is intended for these guidelines which contain nothing new. In response to any criticisms, it will be pointed out that the guidelines cannot be revised in isolation and that a more appropriate time to issue is in the context of the 1987 review.
