HONG KONG: RELEASE OF RECORDS
1.
During your absence in January we consulted Mr Fifoot on the release of certain sensitive 1948 papers on Hong Kong. The most sensitive of these was a legal opinion on the Walled City. We decided to consult the Governor, who has now agreed to the release of the files.
2. The Governor has proposed that we prepare a line in case of press interest in the legal opinion, and refers to the Chan Hing Case of 1958 and the Wong Hon Case of 1959 as giving difficult precedents. I would be grateful for your guidance
on
what legal issues arise to be considered in this connection, and for any suggestions as to how we might deal with
discrepancies between the 1948 opinion and the official attitude adopted in relation to the two cases in question.
