Dear Jonathan,ocalisation" of UK Legislation
Applicable to Hong Kong
We have given some thought to the
arrangements for the "localisation" of UK legislation which is applicable to Hong Kong. To ensure that the exercise proceeds in a structured and co-ordinated manner, we have devised an action plan a copy of which is at Enclosure 1 for your reference. I should be X grateful for any comments you may have on our proposals.
You will see that the first step is to
identify which UK Acts, Orders in Council, etc. are part of the law of Hong Kong or are applied to Hong Kong. We have asked policy Branches to help in this task (a copy of our circular memo is at Enclosure II) but if there is a comprehensive list at your end, we should be grateful to have it as a check against our list.
It would also be helpful if you would request all other Whitehall Ministries, Departments
to consult us, through you, at as early a stage as possible in future when considering new or amending 2 legislation which may be applicable to Hong Kong. This
would allow us to decide at the outset whether and how such legislation should be applied to Hong Kong and help to reduce unnecessary work in any subsequent "localisation" process.
