No. 8 of 1906.

An Ordinance to authorize the construction and maintenance

of certain naval und military works upon and over certain portions of the Crown foreshore and sea bed,

(29th June, 1906).

1. This Ordinance may be cited as the Naval and Military Works Ordinance, 1906.

2. (1) It shall be lawful for the Admiralty to construct upon and over the Crown foreshore and bed of the sea betweco Murray Pier and Arsenal Street in Victoria the works shown and delineated generally in red upon a plan signed by Archi- bald Deacon Shortridge, Esquire, Superintendent Civil Engineer of such works, and countersigned by the Director of Public Works, dated the 12th day of April, 1906, and deposited in the office of the Director of Public Works.

(2) The Admiralty may make such alterations in the said works as they may decm cxpedient so long as such works, so altered, do not extend beyond the limits shown in red on the siad plan and marked "Harbour Boundary", "Eastern Boundary" and "Western Boundary" respectively.

(3) During the construction of the said works, such cofferdams, stagings and other accessory works as may be necessary or contenient for the execution of the said worka may be temporarily constructed and maintained within the limits specified in sub-section (2).

(4) Such works when constructed may be maintained so long as they may be required for the use of His Majesty's services.

3. A duplicate of the said plan signed and countersigned as aforesaid shall be deposited in the Land Office.

4. So far as the said works (including any accessory works) have heretofore been constructed and paintained, such construction and maintenance is hereby validated and lezolized for all intents and purposes, as if the same had been duly effected under this Ordinance.

5. All public rights, privileges and easements in, upon and over such portions of the Crowe foreshore and ses bed as are or shall be occupied by the said works are hereby deter mined and shall be deemed to have ceased to exist prior to the commencement of the said works.

6. Nothing in this Ordinance shall be decmed to affcct the said works except so far as they are upon or over the said foreshore or Bea bed.

7. Nothing in this Ordinance shall be in derogation of Deving of rights any of the powers or rights of the Crown in respect of the of the Crown. said foreshore or sea bed,

Works interfering with works authorised by this Ordinubce are excluded from the Public Reclamations (Validation cod Clauses) Ordinance, 1936; sec No.40 of 1935, 6,12,
