The Secretary of State shall not later than the thirty-

first day of January in each year pay to the Colonial Government

the sum of Ten Hong Kong dollars as an acknowledgment of the

appropriation of the said land.

The Secretary of State shall not part with the possession

of the said land or any portion thereof, but this shall not preclude the Secretary of State from granting temporary encroachments within the perimeter of the said land for the proper management thereof

or for providing services and amenities necessary for the comfort

and welfare of the persons occupying the said land for the said

purposes.

The development and use of the said land by the Secretary,

✓Part 1 of of State shall be subject to the Special Conditions set out in the Schedule here to which shall be binding upon him except in so far as

in the interests of the security or defence of the Colony the Governor

may hereafter agree that compliance therewith may be suspended.

5(a). Before any works are carried out on the said land the

Secretary of State shall, provided there are no compelling security

objections, submit to the Governor for his agreement details of the

general lay-out scheme for the said land together with sketch plans

showing the formation levels design disposition and height of all

buildings to be erected thereon.

(b).

Except for compelling security reasons the Secretary

of State shall not without the agreement of the Governor to the formation

levels design disposition and height thereof erect any permanent

building on the said land which is not shown on the plans submitted

in accordance with the foregoing sub-clause (a) to the Governor

showing the initial development of the said land.

6(a).

In the event of the parties agreeing that the said land or

any part thereof is no longer required for the said purposes the said

land or part thereof no longer required shall revert to the Colonial

Government on such date as the parties shall agree.
