the Government first had and obtained use the Island or any part

thereof for any other purpose and shall not part with the

possession thereof or any part thereof nor assign dispose of or

otherwise alienate the same or the rights hereby conferred or

enter into any agreement so to do.

(c) On the Island or any part thereof ceasing to be used and

occupied for such purposes as aforesaid as to which substantial

non user for such purposes for a period of three months shall be

conclusive evidence or upon any breach non observance or non

performance by the Lords Commissioners of any of these terms and

conditions the operation of this Deed of Appropriation and the

rights conferred hereunder shall terminate and possession of the

Island shall thereupon revert to the Government without

compensation whereupon any buildings or other structures on the

Island (if required by the Government) shall be purchased from

the Lords Commissioners at an agreed valuation any buildings or

structures not so required being removed by the Lords

Commissioners at their own expense within six months of such

termination.

3.

The Lords Commissioners shall make their own arrangements

with regard to water supply and drainage facilities on the Island

So far as is compatible with the intention of this

Appropriation and with considerations of security the Lords

Commissioners shall give access to boat people to obtain fresh

water from the Island between the months of January and June

every year and access to boat women to worship at the shrine on

the Island.

5.

The Government shall have full power to resume enter

into and retake possession of all or any part of the said Island

if required for the improvement of the Colony or for any other

public purpose whatsoever (three calendar months notice being

given to the Lords Commissioners of its being so required) and

upon the exercise of this power the allocation of such Island or

such portion thereof under the terms of this deed shall cease
