para (i) above. This new form of MOA remains to be settled
and as far as I am aware no appropriations have in fact been
made using this new form.

(f) Tenancy Agreement The form of the Agreement in the case referred to
below (Site at Stanley Bay) appears to be in standard form i.e. at a
specified rent and for a term certain "and thereafter half yearly"
until determined.

(g) Crown Land Licence
issued under Crown Land Ordinance (Cap. 28).
The standard form of Licence is employed and is usually for a specified term and provides for renewal at the discretion of the
relevant District Lands Office.

(h) Permit for Temporary Occupation

(i) Licence for Temporary Occupation or "tol" - Apart from reference to
Licence, Licencee etc. this document appears to be identical to a Permit for Temporary Occupation referred to in para (h) above. The Licence comprises the same Clause 8 as contained in the Permit for Temporary Occupation the provisions of which are set out in the reply to Question 2. The issue of a licence rather than a permit may have been influenced by the introduction of the Crown Land Ordinance in 1972. One of the purposes specified in Item 6 of Part I of the 2nd Schedule of the Crown Land Regulations for which land may be used under licence is in respect of
"Military Encroachments".

(j) Memorandum of Concurrence and Assent In the case referred to below
this document provided for the transfer of land from one military body
to another with the assent of the Governor.

have taken the form of a simple letter confirming that Government has no objection to the construction of military facilities on Crown land.
