Two possibilities are envisaged:-

(1) the Central People's Government may take the initiative in making proposals, in which case it would bind itself to proceed only after obtaining the consent of the government of the Special Administrative Region;

(ii) the government of the Special Administrative Region might take the initiative, in which case it would make proposals to the Central People's Government.

28. In both cases the Basic Law would provide that the amendments would only be considered by the National People's Congress after the consent of the government of the Special Administrative Region had been obtained. The consent of the government of the Special Administrative Region would be defined as being that which followed agreement by both the Council of Government Advisers and the Legislative Council. Thus amendments to the Basic Law could only follow agreement by the two councils in Hong Kong, the Central People's Government and the National People's Congress.

The Governor.

29. The Governor will be appointed by the Central People's Government and may be dismissed also by the Central People's Government. The appointment must follow "selection by election or through consultations held locally" (Annex | Article I).

30. After 1997, for the first two or three appointments, the selection of a candidate to be Governor will be by the Council of Government Advisers. Members of the Council will not be eligible for appointment as Governor. The Council of Government Advisers will make the recommendation, and the appointment will then be made by the Central People's Government.

31. After two or three appintments, in about the year 2010, the nomination system will be changed. The Council of Government Advisers will propose a small number of candidates, two or three, to the Central People's Government with a view to seeking agreement that any one of them would be acceptable to the Chinese People's Government for appointment as Governor. The choice from among this list of candidates will then be made directly by the electorate in an election. After the election appointment by the Central People's Government would be formal.
