In his letter NTY/85 1/387/4 of 29 August to you, Jerry Emery asked if NTD (and Hong Kong) could assure him that the "appropriate governor" rule would always be followed in BDTC registration cases.

The guidance given in DSP Vol 46 (Guidance to Governors on the Exercise of their Registration, Naturalisation, Renunciation and Deprivation Functions under the British Nationality Act 1981) is quite clear. Each section explaining the procedures under the applicable sections of the BNA 1981 is headed "Registration Authority" which is shown as "the Governor of the relevant territory or the Civil Commissioner of the Falkland Islands". If the instructions are followed, there should be no doubt as to the relevant territory in each case. I would hesitate to go so far as to say that wrong registrations could never occur, but it does seem unlikely.
