Mr Emery at the Home Office telephoned me yesterday about my
to him of 22 March. He made the following points:

The Home Office think that they will be taking the Order. He is waiting for written confirmation of this from Mr Hyde before letting us know formally.
If the Home Office do take the Order, their own Legal Advisers will wish to draft it.
The Home Office are not very happy about the way in which our Legal Advisers have redrafted Article 4 of the Order. They wish to see some reference to "registration" in the new status.
2. I said that we would await a letter from the Home Office on points (a) (c) above. On (b) I said that it would clearly be important for the draft to be one with which we and Hong Kong agreed. On (c) I explained that we had already put on record the reasons for Hong Kong's aversion to the term "registration". could however see that as now drafted, Article 4 of the Order suggests that acquisition of the new status would depend upon the issue of a BN (0) passport rather than the other way round
