DRAFT HONG KONG (BRITISH NATIONALITY) ORDER 1985

1. This Order may be cited as the Hong Kong British Nationality Order 1985 and shall come into operation on

1985.

2. For the purposes of this Order

(1) a person shall be taken to have a connection with Hong Kong if -

on

(a)

he, his father or his mother

-

(i)

was born in Hong Kong or was found abandoned there as

a newborn infant;

(ii)

was adopted

(a)

(b)

by British Dependent Territories citizens, both

of whom by virtue of this Order cease or but for their death would have ceased, to be British

Dependent Territories citizens with effect from 1

July 1997; or

by a British Dependent Territories citizen

(whether or not the adoption is also by another person) who by virtue of this Order ceases, or

would but for his death have ceased to be a

British Dependent Territories citizen with effect

from 1 July 1997.

(iii) was naturalised or registered in Hong Kong; or

(b) he, his father or his mother was naturalised or registered

an application based on any of the following

(i) residence wholly or mainly in Hong Kong;

(ii)

service in Crown Service under the Government of Hong Kong;
