Thank you for sending me the latest letter from the Home Office.

Whether the Order is handled by the Home Office or the FCO is a matter of policy but the arguments put forward by the Home Office do seem persuasive. Legal Advisers will in any event be happy to offer such help as may be appropriate with the drafting.

Having looked at the list attached to the letter I am not sure that the Home Office have addressed the question of "mixed" BDTCs at all. I am however reluctant at this stage to add to the minuting on this subject. I would suggest that the next step before commenting or sending the list to Hong Kong is to await the new draft from the Home Office, which should set out precisely what their proposals are.
