1.
I attach a copy of a copy dated 4 February from Emery in the Home Office together with the second draft of the Order in Council and should be grateful for your comments on it. I am also sending a copy in parallel to the Hong Kong Government.
2. I also attach, for Mr Grainger only, a copy of Emery's letter of 31 January which contains Home Office views on two points raised in his minutes of 21 and 22 January. The statelessness point has now been clearly set out by Mr Luce in the House of Commons during the Committee Stage of the Hong Kong Bill on
6 February, and attention is now focussing on the position of the second and subsequent generations born after 1997 (see Hong Kong telno 280 attached). I shall be consulting you in due course on a draft submission to Ministers on this issue.
3. I am in general agreement with the Home Office's line on "separate" and "mixed" BDTCs, in particular with the definition marked "X" on page 2 of Emery's letter of 31 January. However, as indicated in his letter of 4 February, the question of definition remains complicated. I should be grateful for your views.
