Whilst this Bill represents a necessary and
desirable amendment to the principal Ordinance, it will be
of direct relevance to the inquiry into the loss of the
'Osprey' for the 'Barquentine Osprey' case. Since the
Marine Court reported its findings in mid-1984, the wreck
of the vessel has been discovered and positively
identified in a location substantially different from that
in which the Court found the vessel was lost. This
discovery, together with other new evidence, suggests that
a rehearing should be ordered. Clause 2(b) of the Bill,
which provides that such an order may be made in relation
to any investigation whether held before or after the Bill
takes effect, will enable this to be done.
