(i) clause 11(2) should be
amended SO as to provide
that in circumstances where
no commercial adjudicator
remains in a trial there
should be a new trial in a
composed of a judge
court
and
three
commercial
adjudicators;
(ii) the Bill should make clear
that the power of the judge
and the adjudicators to
confer in private does not
conflict with the duty
imposed on the judge to
give directions on the law
and his summing-up in open
court;
and after the Secretary of State
had been informed of the
Government's
intention
to
introduce the Bill into the
Legislative
Council
and
explanatory material on possible
questions relating to United
Kingdom practice had
been
prepared;
