(C) THE CHIEF EXECUTIVE MAY APPOINT AND REMOVE ALL GOVERNMENT OFFICIALS, INCLUDING SECRETARY-LEVEL OFFICIALS. THE PRESENT CIVIL SERVICE SYSTEM SHALL BE MAINTAINED, AND WILL BE RESPONSIBLE FOR *IMPLEMENTING THE DECISIONS OF THE SAP GOVERNMENT. TOP OFFICIALS WILL BE REQUIRED TO ANSWER QUESTIONS IN THE LEGISLATIVE COUNCIL. THE ANNUAL BUDGET WILL BE SUBJECT TO THE APPROVAL OF THE LEGISLATIVE COUNCIL, AND THE GOVERNMENT ACCOUNT WILL BE SUBJECT TO THE SCRUTINY OF THE LEGISLATURE. THE EXECUTIVE AUTHORITY SHALL ESTABLISH A WIDE RANGE OF ADVISORY COMMITTEES TO OBTAIN THE VIEWS OF ALL SECTORS OF THE COMMUNITY. DECISIONS ON MUNICIPAL SERVICES SHALL BE DELEGATED TO DISTRICT REPRESENTATIVES ELECTED BY THE PEOPLE.
THE SELECTION OF A LEGISLATIVE COUNCIL AND ITS POWERS AND FUNCTIONS
3. (A) THE LEGISLATIVE COUNCIL SHALL HAVE 60 SEATS, OF WHICH 40 PERCENT SHALL BE DIRECTLY ELECTED, 30 PERCENT SHALL BE ELECTED BY FUNCTIONAL CONSTITUENCIES, AND 30 PERCENT SHALL BE PEOPLE WITH WIDE PROFESSIONAL ABILITIES ELECTED BY THE EXECUTIVE ADVISORY ASSEMBLY. LEGCO MEMBERS SHALL BE FULL-TIME, PAID MEMBERS, AND SHALL SERVE FOR A MAXIMUM OF TWO TERMS EACH OF FOUR YEARS DURATION.
(B) THE FUNCTIONS OF THE LEGISLATIVE COUNCIL ARE TO MONITOR THE WORK OF THE EXECUTIVE AUTHORITY, TO PAISE QUESTIONS, TO COLLECT PUBLIC OPINION, TO EXAMINE BUDGET PROPOSALS, AND TO ENACT AND AMEND LAWS IN CONFORMITY WITH THE PROCEDURES SET OUT IN THE BASIC LAW.
(C) SPECIALIST GROUPS SHALL BE ESTABLISHED BY THE LEGISLATIVE COUNCIL TO OVERSEE THE WORK OF DIFFERENT GOVERNMENT DEPARTMENTS. THESE GROUPS SHALL MAKE RECOMMENDATIONS TO DEPARTMENTS: IF THEY ARE NOT SATISFIED WITH THE WORK OF A PARTICULAR DEPARTMENT. THEY MAY EXPRESS NON-CONFIDENCE AND RECOMMEND TO THE CHIEF EXECUTIVE TO CHANGE THE HEAD OF THE DEPARTMENT. THE CHIEF EXECUTIVE MAY, HOWEVER, RETAIN THE HEAD OF DEPARTMENT BUT SHALL BE REQUIRED TO
GIVE AN EXPLANATION.
THE JUDICIARY
4. THE JUDICIARY SHALL BE INDEPENDENT OF THE EXECUTIVE AND THE LEGISLATURE. JUDGES MAY SERVE UP TO AGE 60 AND SHALL NOT BE REMOVED EXCEPT FOR POOR HEALTH OR MISCONDUCT. A JUDGE SHALL ONLY BE REMOVED BY THE CHIEF EXECUTIVE WITH THE CONSENT OF A TRIBUNAL CONSISTING OF THREE LOCAL JUDGES. JUDICIAL APPOINTMENTS SHALL BE RECOMMENDED BY AN INDEPENDENT COMMITTEE CONSISTING OF MEMBERS OF THE JUDICIARY, THE LEGAL PROFESSION AND PROMINENT LOCAL PERSONALITIES. JUDGES SHALL BE APPOINTED BY THE CHIEF EXECUTIVE, THE APPOINTMENT OR REMOVAL OF JUDGES OF THE HIGHEST RANK SHALL BE MADE BY THE CHIEF EXECUTIVE WITH THE CONSENT OF THE SAR LEGISLATURE AND REPORTED TO THE STANDING
