The Hong Kong Legislative Council (Electoral Provisions) Ordinance, Section 21, provides for the disqualification of a person either from seeking election or from holding office as an elected member of LegCo if he or she has been sentenced to imprisonment in Hong Kong or any other place for a period exceeding 3 months. This applies equally to a member of Leg Co sentenced to imprisonment subsequent to his or her election. Our Legal Adviser has confirmed that this is sufficient to
avoid the difficulties encountered in the Turks and Caicos Islands and that consequently Hong Kong need not be associated with the proposed amendment.
