Amendment of section 6.

ELECTIONS (MISCELLANEOUS AMENDMENTS) BILL

Section 6(1) of the first principal Ordinance is amended—

(a) in paragraph (b) by deleting "New Territories District Board” and substitut-

ing the following—

"District Board in the Regional Council area"; and

(b) in paragraph (e) by deleting "an urban areas District Board" and substitut-

ing the following-

"a District Board in the Urban Council area".

Amendment of section 8.

Section 8 of the first principal Ordinance is amended-

(a) in paragraph (a) by inserting after "ordinary election" the following-

"for District Boards"; and

(b) in paragraph (b) by deleting "at a by-election" and substituting the

following-

Amendment of section 9.

"to fill a vacancy caused by an elected member ceasing to be a member in accordance with section 14".

Section 9(4) of the first principal Ordinance is amended-

(a) in paragraph (d) by deleting “a foreign country or a salaried functionary of

a foreign government" and substituting the following—

"any place outside Hong Kong or a salaried functionary of a govern- ment of such place"; and

(b) by inserting after paragraph (e) the following—

Amendment of section 9A.

Amendment of section 11.

"(ea) is the subject of a decision under the Mental Health Ordinance that he is of unsound mind and incapable of managing himself and his affairs, but a person disqualified under this paragraph shall be eligible for re-election if under that Ordinance it is subsequently found that his unsoundness of mind has ceased;".

Section 9A of the first principal Ordinance is amended-

(a) in paragraph (c) by deleting “a foreign country or a salaried functionary of a

foreign government" and substituting the following—

"any place outside Hong Kong or a salaried functionary of a govern- ment of such place";

(b) by inserting after paragraph (d) the following—

(Cap. 136.)

“(da) is the subject of a decision under the Mental Health Ordinance that he is of unsound mind and incapable of managing himself and his affairs;";

(c) by being renumbered as subsection (1); and

(d) by inserting after subsection (1) the following-

(Cap. 136.)

"(2) Nothing in subsection (1)(da) shall prevent the attendance, participation or voting at a meeting of a Board of a Chairman of a Rural Committee to whom subsection (1)(da) applied if under the Mental Health Ordinance it is subsequently found that his unsound- ness of mind has ceased.".

8. Section 11 of the first principal Ordinance is amended by deleting subsection (2) and substituting the following-

“(2) If such notice is not delivered to the Designated Officer in accordance with subsection (1) the election or appointment of the said person shall thereupon be null and void.”.
