3. CHINESE NATIONALS WHO HAVE THE RIGHT OF ABODE IN THE SAR WILL

BE ELIGIBLE FOR HONG KONG, CHINA'' PASSPORTS ISSUED BY THE

SAR GOVERNMENT. OTHER PERSONS WHO HAVE THE RIGHT OF ABODE, OR ARE

OTHERWISE LAWFULLY RESIDENT, IN THE SAR WILL BE ELIGIBLE FOR OTHER

''HONG KONG, CHINA TRAVEL DOCUMENTS. BOTH CATEGORIES OF

PERSONS MAY ALSO USE TRAVEL DOCUMENTS ISSUED BY OTHER GOVERNMENTS

FOR THE PURPOSE OF TRAVELLING TO AND FROM THE SAR:

THESE INCLUDE

PASSPORTS ISSUED BY THE UNITED KINGDOM GOVERNMENT (SEE PARAGRAPHS

00 TO 00 BELOW).

4. THE ANNEX ENSURES THAT THE FREEDOM TO LEAVE THE SAR FOR ANY

PURPOSE, E.G, BUSINESS, SUTDY OR EMIGRATION, WILL BE MAINTANED SUBJECT TO THE NORMAL EXCEPTIONS UNDER THE LAW, E.G. FOR PERSONS

UNDER WARRANTS OF ARREST. TO FACILITATE THE ENTRY BY SAR

RESIDENTS INTO THIRD COUNTIRIES, ALL TRAVEL DOCUMENTS ISSUEC

TO THEM WILL STATE OR REFER TO THEIR RIGHT OF ABODE IN, OR RETURN

TO, THE SAR.

NATIONALITY

5. THE BRITISH AND CHINESE GOVERNMENTS HAVE SEPARATELY EXCHANGED

MEMORANDA DEALING WITH NATIONALITY AND RELATED ISSUES. THESE

MEMORANDA ARE NOT PART OF THE AGREEMENT. THEY ARE OFFICIAL COMMUNICATIONS BETWEEN THE GOVERNMENTS CONCERNED, SETTING OUT THEIR RESPECTIVE POSITIONS. (SQUARE BRACKETS BEGIN) A SENTENCE

6. ALTHOUGH HONG KONG WILL NO LONGER BE A BRITISH DEPENDENT TERR-

ITORY AFTER 30 JUNE 1997, THE UNITED KINGDOM GOVERNMENT INTENDS TO ASK PARLIAMENT TO ENACE LEGISLATION WHICH WILL GIVE FORMER BRITISH DEPENDENT TERRITORIES CITIZENS OF HONG KONG A NEW FORM OF BRITISH NATIONALITY, WITH AN APPROPRIATE TITLE. THIS WILL CARRY RIGHTS AND ENTITLEMENTS SIMILAR TO THOSE ENJOYED BY BDTCS AT PRESENT, INCLUDING, IN PARTICULAR, THE ENTITLEMENT TO TRAVEL ON BRITISH PASSPORTS. THESE RIGHTS AND ENTITLEMENTS WILL, HOWEVER, NOT BE TRANSMISSIBLE TO CHILDREN BORN AFTER 30 JUNE 1997.
