Office has properly discharged its duties. I enclose the terms of reference which have now been agreed for the Assessment Office and the Monitoring Team.

One of the Monitors will be a Hong Kong Justice of Appeal, Mr Justice Simon Li. We agreed at an early stage that the other should be someone from the UK, and the Prime Minister has now asked that you should be approached to see whether you might be prepared to serve in this capacity.

The exact timing of the test of acceptability will depend on the outcome of our negotiations with the Chinese. This cannot yet be forecast precisely. But we expect the exercise to begin at the end of September and end with the submission of a report by the Assessment Office in late November. The Monitors would thus probably need to be free to carry out these tasks roughly between late September, when the Assessment Office is preparing for the test of acceptability, and late November.

We are still sorting out the financial terms to be offered to the Monitors, but I think you can be sure that they would be reasonably attractive. There would of course be appropriate arrangements made for hotel accommodation and subsistence in Hong Kong.

The Government regard this both as an extremely important and a delicate assignment, and are all agreed that it is one for which your experience and abilities would make you ideally suited. I of course realise that you may have many other commitments. But I hope that you will give it very serious consideration, and let me know whether, subject of course to agreement on details, you could consider taking it on.
