SECTION XIV: RIGHT OF ABODE, TRAVEL DOCUMENTS AND IMMIGRATION

DEFINITION OF CHINESE NATIONALS?

106. See Exchange of Memoranda and appropriate sections of Chinese

nationality law. Broadly speaking, means persons of Chinese race in

this context.

DEFINITION OF ORDINARILY RESIDENT?

107. As under existing Hong Kong law. Allows for limited periods

to be spent abroad.

DEFINITION OF PLACE OF PERMANENT RESIDENCE

108. Persons will be considered to have moved their permanent residence from Hong Kong if they and their family move abroad to live and work for good. Those who go abroad to study or work with the intention of returning to Hong Kong will not be regarded as relinquishing permanent residence.

DEFINITION OF CONTINUOUS RESIDENCE?

Allows, as does existing Hong Kong law, for limited periods to be spent outside the SAR. In defining these limited periods. present practice will continue.

RIGHTS OF ABODE?

110.

All those who have made their permanent home in Hong Kong will continue to have right of abode after 1997. This includes anyone who had right of abode only in Hong Kong before 1997.

POSITION OF NON-CHINESE NATIONALS BORN IN SAR TO PARENTS WITH RIGHT

OF ABODE IN THE SAR?

111. Will acquire right of abode in SAR at birth through parents. Will retain right of abode after age of 21 if they have lived at some time in Hong Kong for continuous period of 7 years and have taken Hong Kong as place of permanent residence.
