lots comprising 11187.4 square metres (120,423 square feet) of agricultural

land. This includes the remaining portions of four lots (Lot No. 1131 R.P. in Demarcation District No. 7 and Lots Nos. 177, 179 and 352 Section B sub-section 1 in Demarcation District No. 16) comprising a total area of 55 square metres (592 square feet) which, although not situated within the resumption limit, are considered to be too small to remain as viable holdings if excluded from the resumption. The general location of the land to be resumed is shown coloured orange on the Identification Plan annexed. The Director of Lands is satisfied that the private land involved is the minimum necessary to implement this project.

Compensation and clearance

As this resumption involves land within compensation Zone 'D' outside Tai Po Outline Zoning Plan area, the landowners concerned will be offered cash compensation at 50% of the basic rate.

Total compensation for resumption and clearance is estimated at $3.77 million for which sufficient funds are available. Compensation will be paid for crops, fruit trees, flowers, bamboo, fences, wells, gates, irrigation pipes and bone pots, together with an ex-gratia allowance for cultivators and ex-gratia disturbance allowances for displaced poultry farmers. 'Tun Fu' ceremonial fees will also be necessary.

The clearance will involve both private land and Crown land. Seven temporary structures used for domestic purposes will need to be cleared. These structures are occupied by seven families (about 31 persons). Four families are likely to be eligible for public housing and the other three families for temporary housing. Ex-gratia domestic removal allowances of up to $1,200 per family cleared into permanent housing and up to $7,000 per family cleared into temporary housing may be payable to these families. Genuine cultivator-families who opt to continue cultivation elsewhere may be eligible for an ex-gratia rehabilitation allowance of $11,000 per family but would then forfeit their public housing priority.

In addition, 20 other temporary

20 other temporary structures including two workshops will need to be cleared. If found eligible, the owners of the industrial undertakings affected will be offered ex-gratia cash allowance in accordance with current policy.
