ARRANGEMENTS FOR TESTING THE

ACCEPTABILITY IN HONG KONG OF AN AGREEMENT WITH THE CHINESE

At the meeting of OD(K) on 23 May, Ministers endorsed the general approach towards testing the acceptability of an agreement in Hong Kong outlined in a paper submitted by the Secretary of State, and invited him to put forward detailed proposals on those lines.

On 8 June, I submitted a draft paper which was based on a first draft produced in Hong Kong. The Secretary of State discussed this at office meeting on 13 June. instructed that the paper should be amended to bring out more clearly the disadvantages of option (ii) in paragraph 8, and to give more detailed explanation of the role of the proposed "monitors" of the assessment carried out by Hong Kong Government. This has been done: the changes have been agreed with Hong Kong and Peking.

We also asked the Governor for his ideas

on possible "monitors" His view, like ours, is that one of the two should be a Hong Kong Chinese High Court Judge. He suggests that the second might be a UK judge with experience in new Commonwealth countries, if one can be found. These suggestions are included in the draft paper.

I submit a revised draft paper and a Secretary letter to No 10 Downing Street, for the next OD (K) on 27 June.
